Terms of Service

These Terms govern access to Tsuki Create, a digital creative service operated under the Tsuki Izakaya Studio brand. By creating an account, purchasing a plan or using Tsuki Create, you agree to these Terms.

1. Eligibility and accounts

You must be at least 18 years old, or the age of legal majority where you live, to create a paid account. You are responsible for keeping your login details secure and for activity carried out through your account.

2. Tsuki Credits

Tsuki Credits are service-use units used to access generation tools. Credits are not money, stored value, cryptocurrency or a financial product and have no cash value. Monthly allocations and rollover limits depend on your plan. Generation costs can vary by model, quality and feature.

3. Subscriptions and billing

Paid subscriptions renew automatically until cancelled. Checkout, tax handling, receipts and payment processing are provided through Lemon Squeezy as merchant of record. You can manage or cancel your subscription through the billing portal. Cancellation stops future renewal; access normally continues until the end of the paid billing period unless the subscription expires earlier under the payment provider's rules.

4. AI generation and outputs

AI systems can produce inaccurate, unexpected or similar outputs for different users. Tsuki does not promise uniqueness, factual accuracy, merchantability or suitability of generated output for a particular purpose. You are responsible for reviewing outputs before publication or commercial use and for ensuring that your prompts, uploads and intended use do not violate law or third-party rights.

5. Your content

You retain any rights you already hold in prompts, uploads and other material you submit. You grant Tsuki the limited rights necessary to process that material through infrastructure and model providers in order to provide the service. Do not submit content you do not have the right to use.

6. Acceptable use

You must comply with the Acceptable Use Policy. Tsuki may restrict or suspend access where necessary to protect users, service providers, third parties or the platform.

7. Availability and changes

Tsuki is an evolving service and may depend on third-party AI and payment providers. Features, credit costs, models and availability may change. We may update pricing prospectively and will not intentionally change an already-paid billing period without notice where notice is required.

8. Refunds

Refund and cancellation rules are described in the Refund & Cancellation Policy. Nothing in these Terms removes rights that cannot lawfully be excluded under applicable consumer law.

9. Liability

To the fullest extent permitted by law, Tsuki is provided on an “as is” and “as available” basis. Tsuki Izakaya Studio is not liable for indirect or consequential losses arising from service interruptions, provider outages, user content or reliance on AI output. Any liability that cannot be excluded is limited only to the extent permitted by applicable law.

10. Governing law

These Terms are governed by the laws of South Africa, while preserving any mandatory consumer rights that apply where you live.
